Terms of Service
These Terms of Service ("Terms") govern all orders, services, and transactions between MakeBigParts LLC ("MakeBigParts," "we," "us," or "our") and any individual or entity ("Customer," "you," or "your") that requests or receives 3D printing, fabrication, or related services. By submitting an order, signing a quote, or making payment, you agree to these Terms in their entirety.
1. SERVICES
1.1 Scope of Services
MakeBigParts LLC provides additive manufacturing (3D printing) services including FDM printing in various materials, large-format part production, post-processing, and finishing. Specific services, materials, and deliverables for each order will be described in the applicable quote or Statement of Work.
1.2 Order Acceptance
All orders are subject to acceptance by MakeBigParts LLC at our sole discretion. We reserve the right to decline any order for any reason, including files that cannot be printed as submitted, prohibited content, capacity constraints, or concerns about intended use. An order is accepted when MakeBigParts LLC provides a written quote and receives payment or a signed purchase order.
1.3 Print Feasibility
Customer acknowledges that not all designs are printable as submitted. MakeBigParts LLC will notify Customer of any issues during file review and may recommend design modifications, but is not responsible for redesigning Customer files. If a file is non-printable and no resolution is found, any deposit paid may be refunded at our discretion minus review fees incurred.
2. CUSTOMER FILES AND INTELLECTUAL PROPERTY
2.1 File Submission
Customer is responsible for submitting print-ready files in accepted formats (STL, OBJ, STEP, 3MF, or as otherwise agreed). Customer warrants that submitted files are free from errors that would prevent printing and that dimensional specifications are accurate. MakeBigParts LLC is not responsible for errors arising from defective or non-print-ready files.
2.2 Intellectual Property Ownership
Customer represents and warrants that they own or have legal right to reproduce all submitted designs. Customer retains all intellectual property rights in their designs. MakeBigParts LLC claims no ownership over Customer-submitted designs and will not reproduce, sell, or distribute them without express written consent.
2.3 Prohibited Content
MakeBigParts LLC will not print: (a) items infringing third-party intellectual property without authorization; (b) weapons or items designed to cause harm; (c) counterfeit goods; or (d) content illegal under applicable law. MakeBigParts LLC reserves the right to determine, in its sole discretion, whether a request falls within these prohibitions.
2.4 File Retention
Customer files may be retained for up to 90 days after order completion for reprints or corrections, after which they may be deleted without notice. MakeBigParts LLC is not responsible for maintaining Customer files as a backup service.
3. PRICING, PAYMENT, AND DEPOSITS
3.1 Quotes and Pricing
All pricing is provided via written quote, valid for 14 days from issuance unless otherwise stated. Quotes are estimates based on information provided at time of inquiry; final pricing may change if scope, materials, or file specifications differ.
3.2 Payment Terms
Unless otherwise agreed in writing: (a) orders under $500 require payment in full prior to production; (b) orders of $500 or more require a 50% deposit prior to production and the remaining 50% upon completion before delivery; (c) ongoing accounts with approved credit terms will be invoiced net-15 from delivery.
3.3 Accepted Payment Methods
MakeBigParts LLC accepts credit card, ACH transfer, and check. Payment is processed through Stripe unless otherwise arranged. All prices are in U.S. dollars.
3.4 Late Payments
Invoices not paid within the agreed period will accrue interest at 1.5% per month (18% per annum) on the outstanding balance. MakeBigParts LLC reserves the right to suspend future orders for accounts with outstanding balances.
3.5 Sales Tax
MakeBigParts LLC collects Massachusetts sales tax on applicable transactions. Customers claiming tax-exempt status must provide a valid exemption certificate prior to invoicing.
4. TURNAROUND TIME AND DELIVERY
4.1 Estimated Lead Times
Turnaround times provided at time of quote are estimates only and are not guaranteed. Lead times begin upon receipt of acceptable files and payment or deposit. MakeBigParts LLC will make commercially reasonable efforts to meet stated timelines but is not liable for delays caused by equipment issues, material availability, file revisions, or circumstances beyond our control.
4.2 Rush Orders
Rush orders may be accommodated based on availability and will be subject to a rush surcharge specified in the quote.
4.3 Shipping and Delivery
Unless Customer arranges pickup, orders will ship via the carrier specified in the quote. Risk of loss transfers to Customer upon handoff to the carrier. Customer is responsible for all shipping costs unless otherwise agreed. MakeBigParts LLC is not responsible for carrier delays, transit damage, or lost shipments, though we will assist with carrier claims as reasonably practicable.
5. QUALITY, REVISIONS, AND RETURNS
5.1 Print Quality
MakeBigParts LLC will make commercially reasonable efforts to produce parts consistent with quote specifications. Customer acknowledges that 3D printing has inherent tolerances, surface finish variations, and material properties that may differ from machined or injection-molded parts. Minor cosmetic variations do not constitute defects.
5.2 Inspection and Acceptance
Customer must inspect all delivered parts within 5 business days of receipt. Any claims of non-conformance or defects must be submitted in writing to chris@makebigparts.com within this period. Failure to notify within 5 business days constitutes acceptance of the parts as delivered.
5.3 Reprints and Remedies
If MakeBigParts LLC determines a part failed to conform to agreed specifications due to our error, our sole obligation is, at our election, to: (a) reprint the non-conforming parts at no additional charge; or (b) issue a credit or partial refund for the affected portion of the order.
5.4 No Returns on Custom Parts
Because all parts are manufactured to order, MakeBigParts LLC does not accept returns except in cases of verified manufacturing defects as described in Section 5.3.
6. LIMITATION OF LIABILITY
6.1 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKEBIGPARTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6.2 Cap on Liability
MakeBigParts LLC's total cumulative liability for any claim arising from a specific order shall not exceed the total amount paid by Customer for that specific order.
6.3 Intended Use
Customer is solely responsible for determining the suitability of any printed part for its intended application. MakeBigParts LLC makes no warranty that printed parts are suitable for structural, load-bearing, medical, food-contact, or safety-critical applications. Customer assumes all risk associated with use of printed parts.
7. CONFIDENTIALITY
MakeBigParts LLC will treat all Customer-submitted design files, technical specifications, and proprietary business information as confidential and will not disclose such information to any third party without Customer's prior written consent, except as required by law.
8. CANCELLATIONS
Orders may be cancelled prior to commencement of production for a full refund of any deposit. Once production has begun, cancellations are subject to a cancellation fee equal to materials and labor expended to date, deducted from any deposit held. Completed parts cannot be cancelled.
9. GOVERNING LAW AND DISPUTES
These Terms shall be governed by the laws of the Commonwealth of Massachusetts. Any dispute shall be brought exclusively in the state or federal courts of Middlesex County, Massachusetts. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.
10. AMENDMENTS
MakeBigParts LLC reserves the right to update these Terms at any time. Updated Terms will be effective upon posting to makebigparts.com or written notice to existing customers. Continued use of services after such notice constitutes acceptance.
11. ENTIRE AGREEMENT
These Terms, together with any applicable quote or Statement of Work, constitute the entire agreement between the parties. In the event of a conflict between these Terms and a signed Statement of Work, the Statement of Work shall control.
